Lis Pendens Question

Samoa profile photo

I was looking on line and found a Lis Pendens that I didn’t quite understand how the process worked. It is in Washington state.

This was the statement that I had a question about….

The general object of said suit is to forfeit all right, title and interest in the property here in after described to the City of ______ Police department based upon Violation of the Uniform Controlled Substance Act, RCW 69.50.5050

I had heard that law enforcement had the right to seize personal property if drugs were involved but what is the next step after this occurs? I am just wondering if some one can let me know what happens in these situations. I am guessing that the county takes the property and puts it up to auction at some later date. If any one can fill me in please do. Thanks

My experience with this is limited to investigating a property that was seized and then listed in the MLS for sale. That property had been the site of a meth lab.

In the case of "controlled substances," I think that the governmental entity that seizes the property and then in effect becomes the owner/seller is at the federal, not state, level -- the D.E.A. At least, the DEA was the owner of the property I was investigating.

    Nancy,
this one did look like it was going to the city. Did you have any luck trying to purchase that property? I am curious to know if any one on this site has purchased properties in a similar situation. The question I have is will government agencies sell directly to a buyer or must they be auctioned off? I am trying to see if this may be an avenue to pursue with purchasing properties. Thanks again for the help.

John, you apparently live in the county that was filed. Thanks for the help.

Thanks for the suggestion on the article. Scary stuff to say the least. The big lesson for me here is that a Lis Pends doesn’t just mean that foreclosure is looming out there. As always I appreciate the help.
