Evicting a Tenant that uses Drugs.

I have a particualar property that has a tenant in it that uses drugs. At least that is what I am suspecting she is doing. Any suggestions on how to proceed if I want to evict her??

    I have heard about a law that started with Bill Clinton that there is a fast eviction for people who are breaking the law. I would check your state to see what you can do.

    Also do you know for a fact that she is using drugs, or did you hear it from somebody??

    Well, I walked in one day and found a make shift bong for smoking pot. I brought it to her attention and she didn't know where it came from.

    I would take that with a grain of salt. I have had a similar situation and addressed them immediately. I sent out a letter to the person and made them aware that if I see anything suspicious, they will be evicted ASAP and the athorities would notified. I also put in that I was concerned for their welfare, and that if the drug paraphernalia wasn't theirs, they needed to find out whose it was and dispose of it. This is a serious matter.

    Is it legal to evict them based on the "drugs" even if they pay on time and are good tenants otherwise?

    Pat, I wouldn't even mess with them. Let the other landlords have them. If you don't take care of your property who will?? I couldn't even imagine the lawsuit to you if there is other drug related crimes that are commited on your property.

    Check to see if your state law allows a 30 day general eviction. These are allowed for ANY reason. Not all states have them. If not you could always have the PD assist in taking care of the situation and then evict based upon illegal activities.

    Whatever happened with that tenant you suspected of drug abuse?

    Oh, so we sent a letter to her telling her that we noticed her drug paraphernalia and said that we were concerned about her health. If we see anything again, we will contact the police in addition to immediate eviction.

    We did have to evict her two months ago for non payment. Case closed. Thanks for asking.

    Ok- I seem to be going through the samething... Its at the point where I can't count on when the rent will come in (she always pays- but no telling when).... to get the eviction ball rolling is it as easy as sending a 30 day notice?

    And what should my follow-up steps be to make sure she is will comply?

    You'd have to check the laws in your state.
