? Deed With Restrictions, Can I Rent?

cmbb profile photo

Ladies and Gentlemen; Need opinion on a restriction written into Quit Claim Deed. It says "No lot shall be used for any commercial activity".
I am purchasing a mobile home and land, near a university, daughter will live in it for 4 years while attending school. I would like to rent a room to a friend of hers for the school year. I may also rent to others after she leaves in four years.

Does that clause prevent me from renting? Thank You

This is a legal question and I am not an attorney. The term "commercial activity" needs to be defined. If you look at zoning, a rental property can occur in a residential zone. I would assume you'll have no problem.

The realtor says it is no problem, he says it means that i can not set up a gas station or ice cream shop or a similar businness . I have reservations with his advice.

Interesting legal question, as I know there are rentals in every residential area in the country.

Probably legally it's none of anybody's business what the ownership interest of the occs might be, and I know very well that if you were to go door-to-door with a questionaire and receive honest answers in any neighborhood in the USA, you'd find that your neighbors were all the way from F&C owners to monthly tenants, etc.

Ergo, if it were mine, I'd rent it in a flash and dare'em to do anything about it.
