Closing And No Survey

Yhagood profile photo

I am scheduled to close on a property next week. I just learned today that my attonery has failed to order a survey. For various reasons, the buyers want to close next week and it normally takes 14 business days for a survey. Has anyone ever closed a deal using an ""Affidavit in lieu of survey."

This does show the importance of recording to the Seller, not just the buyer.

Another good reason for the Seller to insist on recording immediately is to close the door to possible future liability actions.

e.g., 6 monhts after the unrecorded conveyance (deed) somebody falls into a board-covered hole in the ground and breaks a leg...he checks to see who owns the RE and then sues the OLD owner, knowing nothing about the NEW owner.
