Backing Out Of HOA

I have an out of state rental (1/2 of a duplex) that is about 15 yrs old. The unit is close to a neighborhood of townhomes and is included in the HOA for the townhomes. Apparently, when the units were constructed, the original owners of the duplex requested to be included in the Townhome HOA.

The owner of the other half and I are interested in backing out of the HOA. We have paid our dues to date, but with numerous assessment increases, we feel that this is no longer a viable cost.

How do we go about leaving the HOA? Do we have to get a Lawyer involved or do we just file papers at the County?

I have no idea about this so any help would be much appreciated.

    Get a copy of your CC&R to see if doing away with the HOA is even possible. The way out may be as simple as a majority vote.

    Thanks Darryle-CA. Could you please clarify what CC & R means.

    Also, does anyone else have ideas? Opinions?
