WTK: What Is Done During A Phase 3 Environmental

    Hello,

    Typically a phase three is done after a recommendation from a phase 2, which is obviously done per recommendation of a phase 1. The cost depends on the type of firm you have handle the report. In my experience smaller companies, who can be just as qualified as larger ones, charge less. I have never ordered a phase 3 because if a phase 2 fails, I am out the door looking for another deal.

    I fully agree there better be some major incentive for a phase three environmental. This means that major cleanup is involved and fines will ensue until the property is taken care of. In some cases its actually cheaper to pay the fines than to do the clean up, but it is rare, and the property cant be sold until the work is completed per EPA regulations. If you want a general idea of pricing you can do a general search on the internet for Superfund or CERCLA sites, they should have cost estimates listed. Either way you are looking at a major cost that would be worth shopping around.

    Thanks, this property consist of just over 400 acres. Of that some or about 10 acres was used as an unpermited dump for a few years in the 70's and EPD made the original owner stop accepting trash. I saw some picture that epd took when they inspected and I don't know the scope of what else is buried there so I think I will just run away. Anyone have an opinion?

    You can get the seller to pay all costs associated with it and remain liable for it, or take it off his hands for a buck after you find out the costs. But given the unknown costs of a leak or seepage remediation, and the potential lawsuits from neighboring properties, you may want to cover yourelf with lawyers if you pursue it.
