Questions About Mortgage Docs

I live in a PA which is not a spousal state. If only one spouse is on the loan app., which docs should the other spouse sign? Shouldn't they have to sign the mortgage, right to cancel, and the TIL? I am a bit confused on this issue. Thanks!

    I do not know the answer to your question. I think you should consult a real estate attorney because they know the laws in your state. RE attorney's can also act as closing agents, so they know how a real estate closing works. Sorry I couldn't help you further.

    I have brokered loans in Florida (spousal state ?) for quite some time. Here, if only one of the spouse is on the loan application, than the other one only needs to sign on the mortgage doc and not on anything else.

    I would suggest that you simply give a hauler to a title company, and any closing agent will gladly clearify your state's statute in this regards.
