Question on Bill Twyford Partnership Agreement
You made a post, 12/4/02, on the beginner’s forum about partnering with an owner in foreclosure. In my mind this works well before the foreclosure sale date (assuming I have a correct understanding of your post) as follows:
1) Owner agrees to move out right away
2) You get quitclaim deed and Power Of Attorney
3) You put together your partnership (or if you like a trust)
4) Find tenant buyer (T/B)
5) You continue paying on the reinstated mortgage(s) until the future sale to T/B
What happens if the owner is past the foreclosure sale date and they are in the owner’s redemption period (75 days in Colorado less the 15 days notice period). Do you still use your partnership agreement most of the time or just buy the house from the owner with a new loan then give them “moving out” money?
Please let me know when your book comes out on this topic.
