Pre-forclosure Help !

Greetings,
I was on yesterday whininng about no activity from mailings.
I had a response from a letter I mailed Friday. Now I need a little coaching !
I haven't spoken to the owner yet and I'm anxious to get the house under contract. I'm trying to match the owner name to the NOD online. Can't find his name. However I did find an address from one of the NOD's. This house is listed by an agent . The listing date is 1-24-04. I was going to try to get a subject to signed and get a letter fron owner to get the actual mortgage balance. Casn I still do a contract with the owner without the agent or should i contact his agent or use the agent I've corisponded with previously ?

    Not sure what CA rules and reg's are but you can have the seller cancel his/her contract with the agent, if they are going to do a sub2 deal with you. Find out what the seller wants to do and take it from there...

    Last year I had a property listed with an agent, and a week later decided to keep the property. The agent was nice enough to take it off the market, but A friend of mine wasn't so lucky, Here is what happened:
    She listed a house for 6 months, around the 4th month had 2nd thoughts, the fifth month she said she didn't want to sell, The agent said they would not let her out of the contract. The agent got a buyer who accepted everything that my friend wanted and was qualified for the mortgage, Well she didn't sell but had to pay the real estate agent anyway. Hope this doesn't discourage you but this may happen.

    Take the deed record it then call up the agent and tell him to get his sign out of your yard. Just kidding..............................kinda. The agent does not have a contract with you and you owe him nothing.
