My Foreclosure Sale has been protested? HELP

dsREI profile photo

I purchased a nice Single Family home, (at least I though I did), 12 days ago.
Now the Defendant has filed a protest against my sale before I received the Certificate of Title.
I live in Florida where there is a 10 day protest period.

The clerk of the court tells me that I have to petition the court to get a refund?

Has anybody had this happen to them before and how long did it take to get you funds back?

Also, how long will it take the court to decide if they will accept the protest?

I hate having my funds tied up while other goods deals go by!

Right now I’m out my money, no house, no title

That is why we have real estate attorney's who work on our "team." One of the things you should do as a new investor is to start building a "team" of professionals who help you run your business more efficiently. I would suggest you find a real estate attorney who knows the foreclosure laws in your county. They will tell you what your options are and can help you out of your situation.

    Tanya,
Thanks and I am going to see my attorney on Friday.
Just not sure if I want to put more money into the deal if the Judge is likely to rule for the defendant

    Thanks
    Dave
