Foreclose After CH 7 Release..

Loan w/ W MU. Owner (in TX) says Ch 7 released mid Sept. Realty Trac shows NOD Entered: 9-27 - Record 10-28. Owner thinks already went to sale. Can it go to sale that quick after BK release? Is it already REO?

    You can eaily check with county clerk to see if a new owner has bought, or just who does have title now.

    To my knowledge, any bank doing a repo is going to want a new NOD done, as per TX statutes, AFTER the BK court has lifted the "stay of foreclosure", but remember, the Motion to Lift Stay could have been granted a good while before final discharge of BK....which you can also easily check by going to BK Clerk's office and looking at the BK Court File folder.

    Thanx Guys, for the reply's..

    I called the Dal Co Clerk offc. they said they didn't post a new owner for ten days after they received the info on the new owner. And, they didn't get the new info somtimes, for awhile after the sale. I guess the next move is: get a "Loan Permission Letter," signed by owner, then call the Mortg. Co.
    Right?
