Clerk doesn't keep lis pendens??

woodchuk profile photo

Went by the clerk of court in a neighboring county today. I was told that they do not keep (actually she said they don't even receive) lis pendens/default notices, etc. Is this possible?? I was under the impression that any legal instrument that affects the title of real property is required to be public info and searchable. Am I wrong in this? My target county is perfect for my partner and I due to our demographic preferences. I don't want to give up on our pre-foreclosure plans. However, if I'm beating a dead horse by pestering the clerk for info that doesn't exist...I wonder if I should just move on. Any advice?

Thanks so much!
Sonia

    SONIA:

    I smell sumtin FISHY???

Are you talking about the Clerk in the COUNTY RECORDER'S OFC.???

Look for the Recorder of DEEDS, TITLES, MORTGAGES, LAW SUITS, JUDGMENTS, MARRIAGE LICENSES, BIRTH Certificates etc.!!!

That particular clerk may not be the keeper or recorder of these but THEY CERTAINLY CAN aND DO KNOW WHERE TO DIRECT YOU!

Sorry for SHOUTING but this Burns my A$$ets when I hear about lazy know-nothing unhelpful nit-wits on the public pay roll who PLAY STUPID when someone asks them A SIMPLY EZ to Answer Question!

Keep digging someone in that office help help you do the research and Help You to Find Out Where the RIGHT INFORMATION is Located!!!

    Much Success,

Thanks for your response! Ironic, I had just moved over to another topic and was responding to one of YOUR posts! hehe

I went to the county courthouse. The deeds office (even looked like one contractor after another was filing in around me so I felt like I was in the right place anyway). You're right about their "dumb" act. I knew the info had to be their somewhere because the other county I had chosen to target (side by side)...had exactly what I wanted as soon as I walked in. Hmmmm.....If I went to the right place at one courthouse, it stands to reason that I was on track with the other but I'll keep digging! Maybe the "information agent" I chose to ask was having a bad day! Tomorrow...round two!!

One more thing....am I right in assuming that the NOD/lis pendens is the EARLIEST point at which we can find out about a pending foreclosure? I'd hate to find out that I was missing an even better approach.

    Thanks again!
