Creditor Still Reporting After B/K

mwithorn profile photo

I filed for B/K in 2000 and was discharged in mid 2000. My problem now is that I have 2 credit companies still reporting to credit bureaus in 2003 with late payment history. What can I do to get this info off report's confused

I believe you should go to the creditor first and ask them to remove it. If not then go to the bureau and talk to them and tell them you have the BK papers. I think that is it. It has been awhile for me.

Actually I would just go to the reporting agencies with the proof. Send the mail certified, and by law they have a certain amount of time to respond to you. Forget the creditors, they will be of no assistance.

Never send BK papers to a CRA. It cements the BK on your report for the full reporting term.

If you deal with the OCs on the BK reporting rather than the CRAs, you can later attempt to get the CRAs to take the BK listing itself off your reports before it would otherwise be removed by claiming it's not your BK, and other tricky means, but if you've sent them the papers yourself, you can forget it.

ITA - I would write the creditor, dispute the accuracy of what they are reporting, in general. Get proof of delivery of the letter. Follow through on this, insist on accurate reporting. But never give a creditor or a CRA any documentation of a public record, or any other derogatory information. It will stick to you forever.

Mail a copy of the bk papers to all three credit bureaus and ask them to remove the items. They won't even have to contact creditor

I am dealing with a similar, but equally frustrating problem. I disputed an item on my credit report, and the creditor submitted false information. I contacted the agency so I could send documentation of what the bankruptcy really says, but was told all changes had to come from the creditor. Their reasoning was that many times information is omitted from bankruptcy paperwork. THAT response surprised me. <IMG SRC="images/forum/smilies/icon_eek.gif"> [ Edited by pointafter on Date 01/26/2004 ]

If only it was that easy. The CRA will update to say IIB but if the OC reports again it gets overwritten. Some say you can have it locked some say not.

There are a thousand different things that can happen. It depends on many things.

It is that easy. You have to request an investigation, saying you are being denied credit or getting higher interest rates than you deserve because of the their negligence. They are obligated to do this.
