Collector Suing After No Contact Other Than Phone Calls

my wife is being sued by a collection company and going through our records we have not received one piece of mail from them....plenty of phone calls...that we've not answered but no mail. Can they do this? The debt is valid but we've received nothing from them.

    so you are asking if someone loans you money and you do not pay them can they sue you.

    wasn't a loan...was for shady hospital services...disrespectful treatment, misleading statments..yada yada.yada...anyhow...upon further research I found this "First Notice - within 5 days of being contacted by an agency, you must be sent a written notice stating the amount of money due and the name of the creditor. " which would lead me to believe that this company is not doing things the legal way.

    I pay all of my loans and debts that I deam correct and valid, which are all others except this one. I am well aware of the fact that I can be sued by a creditor or collector....but they gotta follow the rules.

    yes...but what are my options now that there is actually a court date set? I've not seen any written comunication from them....I don't even know where to send anything to them....only info we have is the lawyer and she ordered my wife not to contact the collection agency.

    Get an attorney! your past the do it yourself stage..

    You can get a copy of your credit report and look at how the chain of collections were applied to your credit. You can call the original debt holder and explain to them your concerns. Hospitals always want to help if they can. See if you can work it out. good luck
