When Deal Falls Through, What Does The Title Co Get?

bgrossnickle profile photo

I was to sell a townhouse on Tuesday and the deal fell through yesterday. (Putting baseboards up in the laundry room and noticed that the drywall was wet. Cut a hole in the drywall and the framing was wet and the neighbors drywall has the M. They installed a new washer hose six months ago and it leaks.) So, no deal for at least a couple of weeks, maybe more. What would you expect to have to pay the title company??? There was no survey or WDO. But what about time spent on preliminary title search or something like that? Would you expect to pay a title company anything for a cancelled closing?

In every state I have done business, the title company gets paid only if the deal closes.
