    Unless you are a party to the transaction, or have a real estate license, birddogging is illegal...whether the property is listed or not.

    In my town we are finding that alot of people who are going into foreclosure are listing there properties. most of the time they are not even telling the agent that the property is going to be foreclosed on. so we try to work with the agents by giving them there 3% to drop the listing, because they wont get anything if the bank takes it. you might have to have an agent represent you because i believe that they can only take there commision to drop the listing from another agent. obviously they dont get there commision until you close. hope this helps a little. there a ways to work with realtors, believe it or not. P.S. we close on them ourselves and usually dont birddog them. but if the listing is droped i dont see why you couldnt do an assignment of contract.
